	TERMS AND CONDITIONS FOR THE LAKES FREE SERVICE
	These terms and conditions apply if you wish to become a user of the TheLakes free service. TheLakes can be contacted by mail at Upperbeckstones Mill, The Green, Millom, Telephone: 08707 259009, Email: sales@Thelakes.org. PLEASE READ THE TERMS AND CONDITIONS ON THIS WEB PAGE CAREFULLY. When you have read them you will be asked to click on the "Accept" Button to indicate that you have read, understood and agree with the terms and conditions and the authorised use policy set out below. If you do not accept the following terms and conditions and authorised use policy, please click on the "Cancel" button. If you click on "Accept, you will be given access to the Registration Form. Registration for The Lakes Service is free. If you do not wish to proceed, you will be able to visit our public web pages but you will not be able to use our service.

	1. Definitions In these terms and conditions the following words and expressions have the following meanings: 'The Lakes' or 'we' means TheLakes.org at the above address. 'The Lakes Service' means the service provided by Thelakes.org whereby you may gain access to the Internet via a telecommunications network together with the services and facilities provided by TheLakes for you in connection with such service, as described in clause 2. 'You'and 'Your' means you, the person entering into this agreement with The Lakes 'The Lakes Site' means the Internet (global data network) site belonging to TheLakes, which can be found at www.thelakes.org. 'Content' means material provided in the The Lakes Site . 'Information System' means a system for generating, sending, receiving, storing or otherwise processing electronic communications.

	2. Registration Your Personal Information (if no personal information is needed then delete) 2.1 We will respect your personal information and undertake to comply with all applicable UK data protection legislation currently in force, both in respect of the personal information supplied by you on registration and in respect of any of such personal information which we may process.

	2.2 In relation to the personal information provided by you on registration (your registration details) you agree that The Lakes may use such information in accordance with the purposes for which your permission has been obtained on registration.
	2.3 Other than as required by law, or as permitted under these user terms and conditions, we will not disclose your registration details to any third party without your prior permission.

	3. Our Obligations to You(add any obligations that are missed out) 3.1 Whilst we agree to use our reasonable endeavours to maintain The Lakes in a fully operating condition and error free, we have no control over the Internet or telecommunications networks. Accordingly, TheLakes is provided without any warranties or guarantees unless specifically stated.
	3.2Your dealings with, and interest in, promotions, services, or merchants found on or via TheLakes, unless explicitly stated by us, are solely between you and the person with whom you are dealing. Should any dispute arise between you, TheLakes may endeavour to help you resolve the situation, BUT WE WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSSES OR DAMAGES THAT MAY ARISE FROM ANY SUCH DEALINGS.
	3.3 We reserve the right to suspend, restrict, or terminate your access to The Lakes at any time for any reason.

	4. Your Obligation to Us 4.1 You agree that you will only use The Lakes Service in a manner that is consistent with these user terms and conditions, in accordance with the authorised use policy set out below and such other instructions concerning its use as are set out from time to time on the The Lakes Site, and in such a way as to ensure compliance with all applicable laws and regulations, including the terms and conditions of any connected networks or Internet standards.
	4.2 You are responsible for the provision of and payment for telecommunications services necessary to access and use The Lakes. You are responsible for providing a suitable PC, modem and any other items of hardware or communications equipment necessary to enable you to access the The Lakes Service. You are also responsible for making your own back-up arrangements. 6.7 You agree that the material and content contained within or provided by TheLakes is for your personal use only and may not be used for commercial purposes or distributed commercially without our prior written permission. Your use of TheLakes carries with it no rights in relation to copyright or other intellectual property rights in Thelakes.
	4.3 You agree not to use The Lakes or the services made available to you on or via The Lakes in such a way that you cause the whole or part of The Lakes or such services to be interrupted, damaged, rendered less efficient or in any way impaired.
	4.4 You will not insert or knowingly or recklessly transmit or distribute a computer virus which could corrupt data present on the The Lakes Site or any other sites.
	4.5 You will not hold The Lakes or any of its third party contractors liable in relation to the accuracy, reliability, availability and performance of resources accessed through the The Lakes Service which you acknowledge are beyond our control and are not in anyway warranted or supported by TheLakes or it's third party contractors.

	5. LIMITATION OF OUR LIABILITY TO YOU 5.1 THE LAKES SITE, THE CONTENTS, AND THE LAKES SERVICE ARE EACH PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY REPRESENTATION, WARRANTY, CONDITION, UNDERTAKING OR TERM EITHER EXPRESS OR IMPLIED INCLUDING BUT NOT LIMITED TO ANY IMPLIED TERM OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE AND ANY TERMS AS TO THE PROVISION OF SERVICES TO A STANDARD OF REASONABLE CARE AND SKILL OR AS TO NON-INFRINGEMENT OF ANY INTELLECTUAL PROPERTY RIGHT.
	5.2 IN ADDITION THELAKES EXCLUDES ANY REPRESENTATION OR WARRANTY THAT THE CONTENT, FACILITIES, AND/OR SERVICES ACCESSIBLE VIA THE LAKES SITE WILL BE FREE FROM DEFECTS, INCLUDING BUT NOT LIMITED TO VIRUSES OR OTHER HARMFUL ELEMENTS, WILL BE ACCURATE, UP TO DATE, UNINTERRUPTED OR ERROR FREE.
	5.3 THELAKES HEREBY EXCLUDES TO THE FULLEST LEGAL EXTENT PERMITTED ALL LIABILITY FOR ANY LOSS OR DAMAGE WHATSOEVER AND HOWSOEVER INCURRED INCLUDING CONSEQUENTIAL OR INDIRECT LOSS OR DAMAGE OR ANY DAMAGE TO GOODWILL OR PROFITS WHETHER ARISING IN TORT CONTRACT OR OTHERWISE DUE TO OR IN RELATION TO YOUR ACCESS TO THE LAKES SITE AND USE OF THE THELAKES SERVICE OR INABILITY TO ACCESS THE LAKES SITE AND USE THE LAKES SERVICE.
	5.4 THE ABOVE EXCLUSIONS AND LIMITATIONS OF LIABILITY SHALL NOT APPLY IN RESPECT OF OUR LIABILITY IN NEGLIGENCE FOR DEATH OR PERSONAL INJURY.

	6. Events beyond our control We shall not be liable to you for any delay or failure to comply with our obligations under these terms and conditions if the delay or failure arises from any cause which is beyond our reasonable control, including (without limitation) any act of God or of government or regulatory authority, or other Internet services provider, war, terrorism, or non availability or malfunctioning of a telecommunications or broadcast or other network system or service.

	7. Amendments to these Terms and Conditions 7.1 These user terms and conditions may be amended from time to time They may also be extended to include other conditions applicable to specific products or services offered by Thelakes from time to time.
	7.2 Thelakes reserves the right in its absolute discretion at any time and without notice to remove, amend or vary the content which appears on any page of this site.

	8. Termination of these Terms and Conditions 8.1 We reserve the right to terminate the contract between us as set out in these terms and conditions, and your use of the Thelakes Service at any time, by notice to you sent via the Thelakes Service, or via e-mail, or by letter addressed as set out in your registration details. Termination will occur at the time we transmit the message or post the letter.
	8.2 Any notice sent electronically by e-mail or otherwise:
	8.2.1 will be deemed to have been sent by us once it enters an Information System outside our control;
	8.2.2 will be deemed to have been received by you [seven days following transmission][at the time that in a readable form it enters an Information System which is capable of access by you];
	8.2.3 will be deemed to have been dispatched where you ordinarily reside or if you are a business at your principal place of business;
	8.2.4 will be deemed to have been received where you ordinarily reside or if you are a business at your principal place of business.
	8.4 We may terminate the contract between us: (a) if you breach any of these terms and conditions;or (b) if you do not use the Thelakes Service [at least once during a [30] day period] We will notify you in the same way as set out in clause 8.1
	8.5 We reserve the right to suspend or require a users Website to be moved to another server should there be an abnormal number of accesses to a users Website so that they exceed the bandwidth set by Thelakes.

	9. Intellectual Property Ownership All copyrights and other intellectual property rights in the design and content of the The Lakes Site remains the property of The Lakes or the content owner, as appropriate. You must not use any copyrights or other intellectual property rights to republish, distribute or reproduce any of the content obtained from the The Lakes Site. You are prohibited from using any Content in connection with any commercial or business enterprise. Any unauthorised copying of the design or contents of the The Lakes Site, or other unauthorised use will infringe the rights of Thelakes and its licenser's under international treaty and English law.

	10. Severability In the event that part of these terms and conditions become invalid or unenforceable the remainder of this agreement shall remain valid and enforceable.

	11. Governing Law These terms and conditions shall be governed by and interpreted in accordance with English Law and the English Courts shall have non-exclusive jurisdiction to resolve any dispute between us.

	12. Entire Agreement This agreement contains the entire agreement and understanding between the parties relating to the subject matter of this agreement, that of the TheLakes Service
